PRIVACY POLICY - CPA

This section provides information specific to Colorado Residents. This Notice supplements our Privacy Policy. Please see our Privacy Policy for more information on the type of personal data we collect, how we use it, and who we share it with.

Pursuant to the Colorado Privacy Act (“CPA”), Colorado residents have the right to be informed about the data we collect about them. This Privacy Notice applies solely to natural persons who are Colorado residents, as defined in the CPA. Please note that this Privacy Notice does not apply to Colorado residents who are acting as employees or job applicants.

If you are a Colorado resident, you have the following rights:

• The Right to request confirmation from Giftberry, that we hold personal information about you and to the extent we keep such information, you have the right to access and obtain a copy of your personal information held by Giftberry
• The right to request a correction of inaccuracies in your personal information held by Giftberry
• The right to request deletion of your personal information held by Giftberry

As described in this Privacy Notice, Giftberry, may process certain personal information that is considered “Sensitive Data.” Processing of sensitive data only occurs when you knowingly take affirmative action to provide such information to us for processing.

Sensitive personal data means: (A) data revealing racial or ethnic origin, religious beliefs, mental or physical health condition or diagnosis, sex life, sexual orientation or citizenship or immigration status, (B) the processing of genetic or biometric data for the purpose of uniquely identifying an individual, (C) personal data collected from a known child with parental or guardian authorization and consent, or (D) precise geolocation data. To the extent that we collect sensitive data, you have the right to consent or revoke your consent to the collection and/or use of such data.

As described under our “Cookies Policy,” some of Giftberry’s website and mobile applications use cookies, web beacons and other similar tracking technologies to enable essential features, or for data analytics and marketing purposes. You may opt-out of these technologies by modifying your cookie preferences by clicking manage settings on our website.

Giftberry, does not conduct “profiling” as defined by Colorado law.

We will not discriminate or retaliate against you for exercising your consumer rights under the CPA.

Giftberry, will respond to all requests within 30 days. To respond to your requests to access, obtain a copy of, correct or delete your personal data, we will need to verify your identity and/or authority to make such requests and access, receive, modify or delete such personal data.

When you submit a request, we will take steps to verify your identity. You are not required to create an account with us to submit a request. We may ask you to provide us with information about yourself in order to verify your identity. We will only use the personal information you provide in connection with identity verification to verify the requestor’s identity or authority to make the request and whenever feasible, we will attempt to match the information you provide with information we may already have about you.

Decisions made by Giftberry, pursuant to any above request may be appealed to Giftberry’s Privacy Officer by submitting a request to review the decision by mail at Giftberry, Attention Privacy Officer, 1931 Cordova Rd, Suite 2101, Fort Lauderdale, FL 33316, or by electronic mail at service@GiftBerry.com. Within 45 days of your submission, we will inform you in writing of the appeal decision with an explanation of the reason for the decision. If your appeal is denied and you are unsatisfied with the outcome, you may contact the Attorney General of Colorado using the following link to submit a complaint:  https://coag.gov/file-complaint/.

You may designate an authorized agent to request any of the above rights on your behalf. You may make such a designation by providing the agent with written permission, signed by you, to act on your behalf. Your agent may contact us as set forth in this Notice. Even if you choose to use an agent, as permitted by law, we may require you to confirm you have authorized the agent to act on your behalf or require you to verify your own identity.

Our websites and mobile applications link to other websites that are not operated or controlled by Giftberry. We do not monitor or control, and are therefore not responsible for, the privacy practices or the content of linked external websites. We recommend reviewing the privacy policies for any linked websites you visit.

We may make changes to this Privacy Notice periodically and will provide at the top of this Notice the date it was most recently updated. Using our websites, mobile applications, or services where this Privacy Notice is posted or noticed constitutes your acceptance of our privacy practices.
